FITWithRCMC — for people using the FITWithRCMC app

These terms govern your use of the FITWithRCMC mobile app as a patient. If you're a clinic evaluating or licensing the platform, see our Business Terms of Service instead — that document applies to your clinic, not to you as an individual app user.
By downloading, accessing, or using the FITWithRCMC mobile application (the "App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.
Medical Disclaimer: FITWithRCMC is a fitness tracking and educational tool. It is NOT a substitute for professional medical advice, diagnosis, or treatment. Always consult your physician or qualified health provider before starting any fitness program.
You must be at least 18 years old to use the App. By using the App, you represent that you meet this age requirement.
FITWithRCMC is provided to you through your clinic's license to the FITWithRCMC platform. You do not purchase the App or any subscription directly from us:
The App lets you log meals and workouts, message your coach, join classes assigned by your clinic, track habits and progress, and optionally connect Apple Health or Google Health Connect. Features available to you are determined by your clinic and coach.
Camera and photo library. The App may request access to your camera or photo library to let you upload progress photos and meal photos. These are used only for the tracking and coaching features described here — not for any other purpose.
Apple Health / Google Health Connect. Connecting Health data is optional and controlled entirely by you. If you connect it, you choose which data types to share (such as weight, steps, or workouts) through your device's own permission screen, and you can disconnect at any time in your device settings.
FITWithRCMC uses artificial intelligence ("AI") in parts of the App, including an AI chat assistant that answers questions and provides coaching-style guidance, automated check-ins that review your logged progress, and AI-based photo recognition to help estimate nutrition content from meal photos.
You are interacting with AI, not a licensed medical professional, unless a message is explicitly identified as coming from your human coach. AI features do not diagnose, treat, or provide medical advice, and are not a substitute for care from your physician or a qualified healthcare provider. AI-generated responses may occasionally be inaccurate or incomplete. If you have a medical concern, a possible emergency, or a question about a medication or health condition, contact your doctor or emergency services — do not rely on the App's AI features for that purpose.
Photos, messages, and health data you provide may be processed by third-party AI providers acting as our service providers under contract. We do not permit these providers to use your data to train their own general-purpose models.
Nutrition guidance. AI-generated meal plans, macros, calorie estimates, and other nutrition guidance are for informational and tracking purposes only and are not a substitute for professional medical or dietary advice. If you have a medical condition, are pregnant or nursing, or are under the care of a physician or dietitian, consult them before relying on this information.
Eating disorder awareness. If you have a history of disordered eating or concerns about calorie or macro tracking, we encourage you to consult a qualified healthcare provider before using the App's tracking features. The App is not designed to diagnose, treat, or manage eating disorders. If you are struggling with an eating disorder, please seek support from a qualified professional.
You agree not to use the App for any unlawful purpose, harass or share inappropriate content in community features, attempt to access another user's account, interfere with the App's operation or security, or use bots or scrapers against the App.
"User Content" means photos, videos, messages, or other content you upload through the App, including progress photos, meal photos, and Live Stream content. By uploading User Content, you grant RCMC a worldwide, non-exclusive, royalty-free license to host, store, and display it solely to operate and improve the App. This license ends when you delete the content or close your account, except for a limited period in routine backups or content already shared with others. You represent that you own or have rights to any content you upload. We may remove content that violates these terms or the law.

To the fullest extent permitted by law, RCMC Medical Weight Loss shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability is limited to the greater of $100 or the amount your clinic paid FITWithRCMC on your behalf in the past 12 months. We are not liable for loss or unauthorized disclosure from a breach that occurs despite reasonable, industry-standard security measures, or that results from your own actions or third-party providers outside our reasonable control.
You can request deletion of your account and data at any time from within the App, or by contacting [email protected]. See our Privacy Policy for details on what happens to your data when you delete your account.
We may suspend or terminate your access to the App at any time for violation of these terms. Upon termination, your right to use the App ceases immediately.
We may update these terms at any time. Continued use of the App after changes constitutes acceptance. We will notify you of material changes via the App or email.
These terms are governed by the laws of the State of Texas. Disputes will be resolved by binding, individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except as set out below. You and RCMC each waive the right to a jury trial and to bring or join a class, collective, or representative proceeding. You may opt out of arbitration by emailing [email protected] within 30 days of first accepting these terms, with your name, account email, and a statement that you wish to opt out — disputes will then go to the state or federal courts in Williamson County, Texas. Either party may bring an individual claim in small claims court instead, if it qualifies.
